Terms of Service

1. Acceptance and Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and have the legal capacity to enter into these Terms.

2. Description of the Service

TradeBindr is a platform for trading card game collectors. It lets you track and value your collections, scan cards to add them, build watchlists, connect with and follow other collectors, list cards as available for trade, and arrange trades with other users. We may add, change, or remove features at any time.

3. Accounts

• You must provide accurate, current information when you create an account and keep it up to date.
• You are responsible for safeguarding your login credentials and for all activity under your account.
• You may register using email and password or by signing in with Google or Apple.
• You may not create or use more than one account to evade restrictions, or use another person’s account without permission.
• Notify us promptly at hello@tradebindr.app if you believe your account has been compromised.

4. User Content and License

“User Content” means anything you submit to the Service, including collection data, card photos, listings, profile information, ratings, and reviews. You retain ownership of your User Content.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use your User Content as necessary to operate and provide the Service — for example, to display your public profile and listings to other users and to process card images for scanning. This license ends when you delete your User Content or your account, except to the extent it has been shared with others who have not deleted it, or where we must retain it as described in our Privacy Policy.

You represent that you have the rights necessary to submit your User Content and that it does not violate these Terms or any law or third-party right.

5. Acceptable Use

You agree not to:

• Engage in fraud, deception, or any dishonest conduct toward other users.
• List, trade, or attempt to trade counterfeit, fake, stolen, or otherwise illegal items.
• Infringe anyone’s intellectual property or other rights.
• Harass, threaten, abuse, or defame other users, or post unlawful, hateful, or sexually explicit content.
• Send spam or unsolicited promotional content.
• Scrape, crawl, or use bots or other automated means to access the Service except as expressly permitted.
• Circumvent blocks, account restrictions, or any security or access controls.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.

6. Trading and Marketplace

TradeBindr helps collectors find each other and arrange trades, but trades, payments, and shipping happen directly between users and off-platform. We are not a party to any transaction between users.

• We do not process payments, hold funds, or act as an escrow agent.
• We do not take possession of, inspect, authenticate, or guarantee any card or other item, including its condition, grade, authenticity, or value.
• We do not guarantee that any trade will be completed, that items will be shipped or received, or that any user will act honestly or as agreed.
• Ratings, reviews, reputation scores, and similar features are user-generated and provided for informational purposes only; they are not a guarantee or endorsement by us.
• You transact with other users entirely at your own risk. You are responsible for evaluating counterparties, agreeing on terms, arranging payment and shipping, and complying with applicable laws and taxes.

If we introduce on-platform payment or escrow features in the future, additional terms will apply to those features and will be presented to you at that time.

7. Card Data and Pricing

Card catalog information, images, and pricing are provided by third-party sources (including TCGplayer/TCGCSV and the Pokémon TCG API) and by automated recognition tools. This information is provided “as is,” may be inaccurate, incomplete, or out of date, and is for general informational purposes only. Prices and portfolio values are estimates, not appraisals or offers, and do not constitute financial or investment advice. You should independently verify any information before relying on it.

8. Fees

The Service is currently free to use. We reserve the right to introduce paid features, subscriptions, or other charges in the future. If we do, we will provide notice and the applicable terms before you are charged, and any purchases made through a mobile app store will also be subject to that store’s terms.

9. Intellectual Property

The Service, including its software, design, and the TradeBindr name and logos, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.

Trading card game names, logos, card images, and related trademarks — including Pokémon, Magic: The Gathering, Yu-Gi-Oh!, and One Piece — are the property of their respective owners. TradeBindr is an independent product and is not affiliated with, endorsed, sponsored by, or otherwise associated with those owners.

10. Third-Party Services

The Service relies on and may link to third-party services and content. We are not responsible for third-party services, their content, or their practices, and your use of them may be subject to their own terms and privacy policies.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, or apply restrictions such as trade restrictions, at any time if you violate these Terms, create risk or legal exposure, or for any other reason at our reasonable discretion. Provisions that by their nature should survive termination — including User Content licenses already granted, disclaimers, limitations of liability, and indemnification — will survive.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION (INCLUDING CARD DATA OR PRICING) IS ACCURATE OR COMPLETE.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRADEBINDR AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR ITEMS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY TRANSACTION BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold harmless TradeBindr and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your transactions with other users, or your violation of these Terms or any law or third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction and venue of those courts.

16. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect means you accept the updated Terms.
